In no way am I an attorney, just going by experience in plenty of these dispositions I've dealt with....but every state is different, every case is different, and often a lot of the trusts and such are set up wrong or never executed....for example trust is set up, but assets never transferred....or things happen like a car is put in the trust, car sold, new car purchased and not put in trust...so now that car gets divided based on the will, and not the trust documents.
