I'm sure everyone here has heard of the horrible tragedy of ther Champaign towers in Miami.

@Aaron Gordy Not to make lite of a tragedy, but we don't see condo buildings collapsing or drywall with built-in fungus in Austin. 

We are thinking of doing it this way in case a tragedy of either death or divorce at it will hopefully shelter the other one if this where to happen.

It's a good question - and we don't speak much, she keeps to herself mostly, and she had a family tragedy right as we moved in, it's all to say, I don't have much connection with her, but that could/should change, in order to find out IF she has any interest or motivation to sell. 

Those are the ones that showed me the tragedy of what we're doing.

BUT..... in a City where the waiting list has reached decades for a family to have a decent sized apt, it is a tragedy that a family that could have an appropriate sized apt cannot because of the big shortage of large size apts. 

It’s a tragedy for everyone: you can’t live there, landlord can’t collect rent.

Hope you and yours were unharmed in the tragedy. 

Since this is more of a "house hack" and they're merely renting a room, it isn't illegal per se but you would do well to protect yourself from liability in the event of a tragedy.
