In this situation, the nursing home (or rather Medicaid) would most likely have no standing to any proceeds from the sale or rental of the property.This is just my lay opinion.

They say, " if you can't take the heat then stay away from the fire", in other words if you can't absorb the cost of doing business then you are in the wrong business, simple as that.This is why I can't stand all of the jerks selling people on the concept that people can do real estate with absolutely no money, no credit, and no experience.

There were other items in the cell tower lease as well such as the way the seller of the retail center was counting the cell tower value and buy backs and assignability rights.Typically a cell tower revenue, monument sign for tenants revenue, free standing ATM machine, billboard is not counted and weighed the same as the building revenue with tenants themselves.

Even then, make sure you are comfortable with it because I feel like a lot of these guys are really pushing the envelop and I don't know how well their stuff would stand up in a court of law or against the IRS.
