The owner at one point declared bankruptcy, but that was dismissed about 6 months ago, which allowed the foreclosure sale to happen today.

How often within a half million to million dollar plan can a person sell a property before the IRS declares it a business?

I'm aware of current laws in terms of collecting that unpaid rent but he also has not sent a single hardship declaration. 

Have a lease with you, collect declare and report rent (they can gift back rent to you) etc...
