Bill, a few of the attorneys that I have spoke to about this all have different opinions, and see to think that this could still be done because there is so much to this SAFE Act that the legislation really does not know whats going on with it yet, or how to handle it.

The State Constitution would have to be changed which takes a vote of the people and right now the conservative view in the state is that individual personal rights trump governmental economic turmoil.I am paraphrasing the facts of the case but unfortunately this is not just a legislative exercise rather a constitutional one.

I would be extremely surprised if there were something which overrode that.I do remember that in the wake of the financial crisis there was talk of some legislation to protect tenants in the case where the owner hasn't paid her/his bills and loses the property.

With the current draft legislation under consideration in the House Ways and Means committee, specifically section 138312 that will end the ability of IRAs to invest in private offerings targeting accredited investors (yes, that means syndications through Regulation D so either 506b or 506c which affects accredited and non-accredited sophisticated investors), how do LP investors & sponsors out there plan to handle this provision if it passes both chambers and is signed into law?

As long as the seller is paying through the reduced price it is a OK deal.If you already have a property with utilities included you need to see if your state legislation allows you to bill back tenants.
