They amended the PPM to accept more investors under a different section of the SEC code and investors were given a choice to leave or stay int he fund because of the change in the fund's structure. .

The new amendments really put me in a tough spot since i'm in escrow.  

If they do answer, go to court, cite what you believe to be the fake lease and also ask for your petition to be amended asking for the new relief (rent).

You might want an amendment to your contract that the seller will address any material degradation in the property between now and then since it is 3+ months away.  

If your rent is too high for the tenant you could amend the lease to be a base rent plus a percentage above a certain sales volume so when they do good you get more rent.

We finally heard back from the seller's agent on August 28th via e-mail saying he agreed to it (we requested to close Sept. 30th) A week or so passes and my agent still hadn't received the signed amendment.

It took a while and when the seller delayed on signing a basic contract amendment, I kept at my research. 

On Friday, I amended my offer to reflect the new conditions.
