The bank from my understanding will be writing off a loss on this loan as there is not enough money to go around.Here is where it gets interesting, there is a second lien on the properties from a seller of a hotel that the current owner of the 21 unit bought seller finance. obviously there is not enough money to get this guy paid off as the bank is already taking a loss.

The general issue with accepting a partial payment is that unless there is something in writing to the contrary it can be seen as evidence that a payment plan was made between you and the tenant.

Never had to do this ever before  There are two ways to do this, google and find a template online or get a realtor that can use some promulgated documents by TR.Per law, no-one can write you a legal document except for an attorney or the person providing the document will be infringing the law.In terms of the tenant leaving there is no point to pursue any legal way and for you to get possession, you create a termination notice and then in 30 days you can take possession.
