In any event, if this was a foreclosure auction, the lien from the bank should be gone after the auction UNLESS the auction wasn't run correctly and the lender was not notified or some other flaw in their process.

That said, "chickens coming home to roost" from the various seller-financing deals done WRONG is a very strong potentiality, as issues of such will most likely grow in occurrence and thus possibly press internal audit's that uncover such, and resulting enforcement actions start enacting in a volume.

My initial research uncovered the concern about getting title insurance, but your thoughtful explanation of how this could be remedied is helpful.
