Engaging in a variable rate commission and not disclosing it (essentially making the playing field even so everyone knows the rules) is a violation of the NAR code of ethics, and in many states, a violation of the law. 

While I'm not going to be one to praise NWA for their ethics by any means, it really is on the buyer to due their due diligence or don't buy the deal.

But as someone who started in real estate before being licensed, there is a place for ethical wholesaling.
