You would have to agree to amend the TIC agreement to provide that you indemnify them from any and all damages that may result from a default on the mortgage, you should also agree that if there was ever a foreclosure started, they would have the immediate right to recapture your interest and pay off the lien, or sell your interest and pay the mortgage off with the proceeds.

I'd start the eviction process immediately because they have not contacted you with a date they will pay rent, and this is a pattern.I would also amend your lease to say rent is due on the first and late on the second.

My lender confirmed that putting it in the Trust would be fine as long as the borrower is the beneficiary, but they never said anything about amending the terms of the Trust after the fact.

The HOA's response is that the bylaws and other documents were written in such a way that they cannot amend the rule to provide assigned parking to TH w/out a garage or they would have to provide X number of spots to every TH and SFH resident.
