You should be able to document that fortunate accident and had other things like written communication, the lease itself, your past practice etc all demonstrating that your intent was to hold.

Additionally: whatever you do about this, try to stick to email (other written communication) that you can later go back to in case the tenant decides to claim that he was not fully reimbursed.(1) Ask the former owner for any Lease he had with this tenant (it sounds like you were this tenant's landlord for 6 days - I'd ask for this document during the purchase period.)

I would try texting the listing agent - she's had this property listed on and off since 2008 and has been dealing with the short sale (what a pain for an agent) - she's probably sick of it, not making any money on it and has probably been fielding a million calls from completely unqualified first time buyers who want that area but don't really pay attention to the details and don't have any cash - I would be clear in your communication with her that you understand the requirements and have the cash to close - I've had transactions with her in the past she's been around for a long time.

It wasn't even a problem with the tenant, just bad communication from the PM and I didn't like that.My "turnkey" purchases all have appreciated since I bought them, a few of them more then others.

You are not trying to draft an agreement, simply communicating to your attorney what you have agreed on.Submit to your attorney, he/she will come up with further points that need discussion/decisionsDiscuss again, record your decisions and resubmit to attorneyRepeat until the attorney has drafted an operating agreement that you both agree on (you can see that extensive discussion between the partners will save you in attorney costs)Open a bank account (free or close to it) using the newly formed LLC certificate and operating agreementNow you have a functioning company.
