Response has been overwhelming, and I  believe the vote in each jurisdiction has been reached with unanimous consent from each county council.

The problem is that the occupant has made a cli9am to title of the property stating that the seller had no right to sell to me without his consent and title is clouded at the moment.

In CA, attempts at "AP" require satisfying the actual, open and notorious, hostel and adverse possession, must not be with owners consent, must perform improvement or fence and pay all property taxes during time of occupancy and keep current at time of prove-up for a QTA.

Do you need the "sellers" consent to rent out the property while you're in contract?

My thought is then, what you are doing, if you are allowed to do a Sub-2 transaction with a lender's consent, must be some other arrangement and not a short sale under those parameters.

There are issues of implied consent that can go with a POA for you to act in the best interest of the borrower.

The judge wrote that tenant consents to leave the property.

We are all approaching our STRs with different goals and requirements than someone doing arbitrage would have, and few to none of us have any experience with it that we could use to help.As Nathan and some others have said, just make sure you are setting realistic expectations and most importantly make sure that you're doing everything legally, with your landlord and city's consent.
