He had just purchased a new home and was in the process of selling his other house and his business to his realtor and her daughter. while going through his text messages with his realtor we discovered she was actively encouraging him to take very powerful prescription narcotics as well as having him drive her out of state to buy marijuana products.

If you own the land with the easement running across is (the servient owner) you could have an attorney help you abandon it or transfer to another entity that you control that is different than the entity(ies) that own the subject property and the dominant tenement property.Alternatively, the easement could be modified into a license.If you really want the easement to go away and it turns out that you don't have control of it, hire an attorney to file a quiet title action.Hope a prescriptive easement has not been created by other third parties using the right- of-way for ingress and egress to another area, like beachfront property owners here in CA have to contend with.I'm no expert on entitlement, so your local real estate attorney will be a good source.

If anything, you go to court and the judge allows a prescriptive easement and you are compensated for the square footage of land that is encroached upon.

Depending on certain factors, there may be an easement by prescription at this point, and even if there wasn't you can't just take a chainsaw to your neighbors property if it's encroaching.The advice about having your own guy come out & make sure your roof's water stays off his and then lawyer up when the time comes is spot on.
