If this construction person as a borrower has no money I would question their capabilities to come through on such a deal.I wouldn't put out anything to anyone without the NFA letter.

@Karen MargraveAs long as the IRA mentioned in scenario #1 is transacting with a non-disqualified person as the developer, there should be no problem with the "arms length" rule.

I pay this person a little more per hour and they work about 3-10 hours per week depending on what is going on.
