Rental RE activities are per se passive but can be made non-passive if the taxpayer is an RE pro who materially participates in the activity.Cash flow is not what you're taxed on.

As you start doing more deals and getting more assets (btw this advice @ not using an llc assumes your not a gazzilionaire and a major target) use the money you saved on your first few deals to se a good attorney and accou tantrum to get set up correctly.

The time to do that, of course, is when the annual budget is discussed at the annual meeting.Thing is, if your association is like our HOA, the budget does not actually get voted on, per se.
