I would strongly suggest if that is the case that you confer with a licensed tax attorney and not rely on the guidance of an IRA custodian. 

Unless the agreement was to pay for the eviction -- not to conduct it -- I doubt any of that is enforceable other than perhaps the $75 per diem.
