Reputable turn key companies don't require you to close until the renovation is complete, you've had an independent inspection, a tenant is in place and the property has appraised for the contract price.

I am assuming that if Seller does not Consent, then the Contract is still valid and forces Kevin to purchase the property under Contract.If that's the case, then Kevin's Attorney can re-negotiate a date where both parties can agree to Cancel if Marketable Title is not delivered AND that EM be moved to a new Escrow, such as a big and reputable Title Company as @Jay Hinrichs suggested.
