One land speculation I bought 4 acres in sonoma County CA ( wine country) in 96 for 27k it was unbuildable at the time ( could not get a septic system on it) Well city grew to us The Graton Casino comes in right across the street and we sold a few years ago for over 2 mil to a land assemblage investment company.

My biggest tip here is work with the smaller companies.

Also do not take documents off the internet, get an attorney to draft documents for you and also always close with a title company. 

Your insurance company likely has a no smoking clause on your policy and will back you up as you suspect this.

The company I use has patched the issue since then, but security is ongoing, of course.

Often times when a builder/buyer moves too fast, or is too busy and overlooks a key piece of due diligence, the unethical ones will try the "scorched earth" method and blame everyone but themselves, even when they know it was their own mistake, and they'll see if they can scare you, the seller, the title company et al into paying damages/fixing their problem.
