2) I seem to have read somewhere where an attorney can set up a separation of property, present it to the judge to get a judgement, then show the judgement to the employer's stock administrator to get 90% of the funds out for self directed investment where your spouse is the custodian.

Not an overly common business arrangement as no matter what capital contribution or administrative contribution is made the ownership equity is always 50/50.
