Approaching the seller during the listing period would be unethical, appoaching them after it expires means they are no longer represented and as Seth points out that becomes an issue for the seller if they attempt to sell without paying a commission during the "protected period".Commissions are due an agent as the"procuring cause" of a sale during a period agreed after the listing expires.

However if you bought a property that was brought to you from a Realtor, he could make a claim that they were the Procuring Party and make a case for a commision.

@Brian Adams Thanks for the info procuring larger apartment complexes.How much harder is it to build a new complex in a market where the demand for apartments is very high and the rents keep going up very fast.In my suburb, there are three 100+ unit complexes being built, that I know of.  2 of the complexes were recently approved due to the vacant property not being developed for a while and the land being rezoned to comply.

It basically says that if the property is sold to another person within XXX days and the Buyer was originally introduced to the home by the Agent or the Agent was the "procuring cause" then the Agent should be paid a commission.The right thing to do is to work through the Agent.

Many charge a cancellation fee to reimburse for the money outlay in advertising if you cancel within the 1st so many days/months of an agreement and it's quite common to see cancellation fees after a tenant has been procured.

I was very close to flipping my first house in back in 2007 when I was able to procure sub-prime funds but for various reasons passed it on to another investor.Having been out of the loop for so long, I want to start immersing myself in the wholesaling side of the business and go from there.
