If the LLC funds a loan for more than the purchase price, then I assume the attorney just gives me (the buyer) a refund for the difference at closing?

NOW, if there was a recent storm that cause a sudden leak resulting interior damage you may not have much of a leg to stand on because HOA was not neglegent in doing timely repairs, it just happened.Now if you think they should repair but they won't you will have to sue your HOA (yourself also since you are an owner) Once they board and HOA recieve the letter from your attorney, they will likely just settle and fix your wall inside since it will be way more costly to defend and it may raise they HOA insurance next year, thus passing the cost to you via your HOA dues.

Some state limit the fee you can collect and may limit who can collect - only attorneys for eample.

@Moira Baggett, there is no real answer to this other than: review your operating agreement and potentially talk to an attorney, likely to do the same.Most syndication docs drafted by capable attorneys will effectively state that you are acknowledging these are risky investments and there is a real chance you lose all your money.  

Never sign a contract or put any money up until YOUR Panama attorney has done a complete title search and YOUR Panama attorney creates the purchase contract.
