I cannot figure out from the wording if the Tenant is waiving the right to this act, or the Lessor does, or neither??

They certainly protect the sponsor to an extent and make sure to put limited investors on notice that projections don't always pan out however being a bad actor ISN'T covered.

It can be done but it's tough.We closed a loan in state but we knew all the actors.

Unfortunately a few bad actors can lead to every deal being suspicious which is now where we sit

But I have no sympathy for the bad actors in our business whose actions perpetuate that perception.
