Since it's alleged to be a shared driveway then the best a surveyor would have shown is the driveway on you property and perhaps showing it extending to your neighbor's property.

Cameron,I would suggest staying away from the HELOC option since the rates are adjustable and you can lock into a 30Year Fixed under that percentage on a primary.
