I don't think anything anyone offers is "evidence" in court because you would be backing up your claims with documentation such as the lease, or quotes for work or material prices.

Educate the land owner on the potential profit run the numbers and go over the basic proxy and blue prints.Make sure you have a seasoned and qualified Builder/GC because they can be a deal killer with wasted time and inflated material and extended completion dates.

A lot has happened since starting, between material shortages in SWFL for a while, a massive hurricane, a period of power outage, damages to various parts of the city (and major damages to surrounding cities), high demand in labor/resources, a transformation in permitting systems, and a boom in construction in general.

In that case you should get an attorney involved as encroachment would be a material issue that if known should have been disclosed both to the broker and to any potential buyer.

@David Pike For what it’s worth, I was on a call this evening with a very experienced real estate investment company who stated they don’t expect any material reduction in interest rates for extended time period.  Based on their long-term track record, I would think their opinion is as good as any and better than most.
