Not only from a practical point of view, which is all that really matters, but the FARBAR gives the seller an out if they can't deliver clear title, which they can't.

The loan was secured by 2 properties in Chicago.In the closing documents, there's an Escrow Agreement which says the private lending mortgage broker acts as escrow agent for borrower and lender to hold said Quit Claim Deed: (Escrow agent = private lending mortgage broker) with the following terms1.Borrower agrees to deliver to Escrow Agent an executed and notarized Quit Claim Deed running to Lenders for the properties2.

If units are selling for $480-$490K and you are buying at $400K that is a different story than $478K.2) Make sure that the seller can also deliver the property vacant if you are going to be purchasing as an owner occupant (unless you can cover the down payment and want to take the property as an investment instead of OO).3) Everyone has their own opinion on HOA's.
