Constitution prohibits takings without just compensation and there is nothing in the 11th Amendment that would allow such a levy (the Amendment makes constitutional taxes on income, not wealth).

Pay them, the lease specifies they have use of the garage, if you wish to amend the lease you can just ask, but they may say no, if you offer a small incentive they are more likely to agree, you may also be able to make it so you only pay out if all tenants agree.

Its easy to get caught up with a negative outlook if this passes as its stated verbatim but unless you're a legislator or politician who can take a vote or help amend the bill, its best to begin planning ahead on how to best handle the various scenarios if it goes through.

Townhouse 'rules' could set up maintenance and use of the common area as rules and have a process to amend the rules if both parties agree with each townhouse getting 2 votes or something like that.
