Also, in CCA 201436049 (not precedent but a good indication of where the IRS stands), the IRS refused to apply the limited partner exception to an LLC’s active owner but implicitly accepted its application to an inactive owner.Given the state of the law, those who wish to have certainty in avoiding SE tax should consider conducting business through a limited partnership, either directly or through an LLC owned by the limited partnership.

Thanks for the reply @Jay Hinrichs do check state laws you must be a licensed foreclosure consultant to be negotiating with someone in foreclosure.. like in WA this is a felony.. if the owner has it listed for sale and your a cash buyer that's one thing.. but seeking them out and trying to do a sub too.. you best check into how that works..I did a lot of this until the new laws were in acted in 2007 and they are severe if you run afoul..

Yes, I'm retired, I believe that is mentioned in my profile, you probably overlooked that, retired doesn't mean inactive in RE, it means I don't have to work, that I don't do a 9 to 5, that I don't have to do much as others do things for me, it also means I don't need to do business with anyone I don't want and along with that, it means if someone sends me a snide PM, I can brush them off!
