My potential partner and I have agreed to split everything 50/50 and I was thinking of holding all holding/cash to close funds in escrow and run it through my LLC, but would be interested to hear how any of you structured it in a way that protected yourself in the event that one partner turns out to be problematic.

@Amanda Bahil our lease states that we are not responsible for payments lost in the mail or stolen - specifically to cover events like this.Because of events like this, we also charge tenants a $10 Processing Fee if they send us rent via mail - to encourage them to pay electronically or deposit directly in our business bank account.Unlike the comments of others, we see this as 100% the tenant's problem, though not their fault.How do you think a lender for a mortgage or car payment would treat this?

But I don't know if 1. there's a specific process we have to go through with the city for it to be recognized as a duplex down and 2. we plan to say in the listing that the tenants cannot use the basement as living space, just as rec space/office/etc, but I don't know if that's enough to cover me in the event of a lawsuit for example that there's a fire down there and someone sleeping down there gets hurt.
