It will be forfeited if you don't later buy or go against the purchase price (strike) if you do.  

My RE lawyer advises against this: "failure to have a separate escrow account will forfeit your right to security deposit funds in all instances."

The auction contract says the auctioneer get 50% of the forfeited deposit.

If the offer for my LLC where I own less than 100%, I don't negotiate my comissions - it's my income just like everyone's else - thats what I do for living.Some banks have disclosure that if an agent buys the property in their name or their LLC name, the comissions are forfeited.

I would state in the "agreement to hold property" that they must sign a lease on 3/1 and pay the March rent in full or the deposit would be forfeited.

If a property is not filed on by the deadline this year, the property owner will forfeit any right to a refund for tax year 2023/24 and have to wait another entire year before being able to file. 

They were in violation of the lease by smoking inside and are probably going to forfeit the entirety of their deposit.

They offered to by the rental just 3 months ago and used their deposit for earnest money and walked out on deal so deposit is forfeited .

If late on rent or late to get a loan, all is forfeited.
