You could offer to fix some or all of it, but advise them that the process of them moving in will delay and we will have to postpone the lease to make sure that the items are corrected before they move in.

But I don't think that I can postpone the depreciation recapture unless I do a full fledged 1031---an installment sale alone pursuant to IRC 453 will NOT help with that IMHO.The other question concerns the status of (1) "monetized installment sale" or (2) "structured installment sale" or the like.

Ask the seller if his property is in foreclosure and if he/she says no, let him know there are sites stating it is and then if still not satisfied, you can confirm if its in foreclosure or not by getting a prelim for a nominal fee.if it is and its just the notice of default, there is time but if its the notice of sale, there is little time but still, if there is a deal to be had, the seller can request a postponement showing that they are under contract and anticipate a close shortly.
