By that I mean issues arise that may not necessarily be your fault and when they do and a claim arises, the LLC not you personally will be listed as the defendant (unless you are dealing with a scummy attorney which is extremely rare regardless of what those using scare tactics to sell expensive asset protection systems may tell you).

That being said your feelings probably correlate to things that are not discriminatory and if you can explain your decision that way you should be able to defend yourself.

The sale would resume in 30 days or so but it would stall it for sure.I believe if the OP files a request for a TRO the Trustee will be named as the Defendant and will need to retain an attorney to respond.

If you do go with an LLC, make sure an attorney provides it specific to you (not downloaded from the internet), that teh attorney will defend it in court, that you jave an operatiing agreement and that you follow said operating agreement.
