Hi @Rich Thomas, The key element is not how long you have held title to the property, but whether you can prove that you had the intent to hold for rental, investment or business use.

The other element, is the mount of the expense in view of the big picture, such an expense is probably not that significant.

But repairing that is not that expensive.The heating element I assume is in the HVAC unit . . . this is where I would have an HVAC guy check out the entire system and give you an estimate to repair it all . . . that will be your negotiating chip.Are you flipping or holding this property? 

This time it's still an "ad value", however, the new element is this commercial unit attached, and two of the 4 apartments will be delivered vacant.
