In my experience, they use their own judgement of what is right and fair over legal correctness in many cases.

I don't think your factoring in all the election lead-up "make it rain" vote pandering.

It looks like rain every day, but on and off.

Every afternoon it has rained.  

If this tenant is being honest about their intent to move out of state that makes it MUCH more unlikely that you would ever collect on a judgement against them.

Cue the dramatic music and a small single woman racing through the night with her dogs and cats, in pouring rain and unbelievable wind.

Worst case you will need to seek a judgement if the situation can't be resolved otherwise. 

I'm trying to withhold judgement here but this has me livid.

Have your broker or banker pull and send you rent comps / market concessions / etc. from like kind / vintage / size properties in the immediate neighborhood surrounding your asset in Baton Rouge, and then make a value judgement on whether you have room to push.

It rained a lot here creating soggy grounds and then the winds came, which knocked down a ton of trees and power lines.
