I'm allergic to cigarette smoke, so I feel for your tenant.I don't think that clause you referred to will have any impact on this since smoking is legal, and this would open an enormous can of worms if this went to court.There's only one solution I see, and that's to buy the unit below and either flip it or rent that one out too (after clean up) if the complex allows for it to be a rental. 

Even if you did, you still risk being sued by someone that's allergic to the cushioning material or offended by the color.

Hey good forbid your leaves blow on your neighbor's lawn, COURT and fines.and do not forget about cutting your lawn " It creates allergens that humans are allergic to " cant make this stuff up folks.... 

I'm pretty sure no one would want to live there except for maybe someone allergic to the sun.  

I do not allow cats since I am highly allergic to them.I also should have mentioned that I do have size and breed restrictions. 

What if they're allergic?

The relationships are loyal, rewarding, respectful and appreciated.I too love taking a concept and being a part of making it real and definitely know that I don't like pushing paper all day... years ago, I learned that I was allergic to being in an office all day!  

You could also wear one of those suit things if you are allergic.
