An exception os if the owner of record is an individual and places the property in a trust that operates as a pass through entity,  the sale or transfer of said trust is a violation of the due on sale clause. ”The Garn-St Germain Act is a federal law that allows lenders to enter into or enforce contracts, including mortgage agreements, which have due-on-sale clauses even if a state’s constitution or laws, including their judicial decisions, prohibit such clauses.

U dont hear much about it .. its a niche and anyone who has taken back a seller carry back note usually gets a few direct mail peices offering to buy your note.. thats all it takes  its public record make contact offer to buy .. etc.

No 8 years LOL.I already stopped listening to RIA or whatever, until they all open their sponsor track record LOLThe only advantage of having DST is really because it's just like investing to MF Class A, but the yield and cap is so volatile right now, I bet the safest DST would be the one with less than fifty percent LTV.

same with us, we study infill every day though through case examples. the best part about infill is no risk. buying lots like what builders are doing even national builders still are shifting the risk to local land developers. my recommendation is to look at permitted uses, price per acre, etc. if you want lower risk buy a larger tract of land from a large developer out of a 100+ acre development to lower the risk. if you are doing it from scratch work with a group who's doing subdivisions. you can go and read the subdivision plats in your recorders office online every county has one. in columbus where I do the majority of our development we are specifically starting to target zones where the economics are also favorable.

Quote from @Kristin Vegas: @Nathan Gesner thanks for taking the time to respond, i do have a question: i own 2 homes and one of them now is vacant, the tenant moved out and march will be 3 months of vacancy. the tenant moved out december 31 and the management handy man finished the respair almost the end of January. nothing major just paint the wall and some carpert cleaning. so far i received 2 applications but it was denied because they didn't feet the criteria, because these applications the management guy which is the owner of his company as well said that there were more applicants but he didn't even bother to send it to me because those applicants had bad criminal records. last week he said there was. more applications and he was going to check it but i haven't had any responses from it. today i called him to ask qbout those applications and he sounded a bit upset and said that he was gonna check it today, same thing he told me last week, i also asked his helper and she said that he was the one encharged of my rental. everytime i call him he sound busy. he seems to be all over the place and sometimes i think that he is just not taking the time with my property. also last week i told him that if he could pls change the description of my property online and to add that i accept section 8 tenants and he said ok but still hasn't happen because i check the description and is still the same as it was, i'm new in this and any tip i will appreciate it 🙏 What is the market like where the rental is?

We have some more affordable studio units that I fear will attract the budget concise crowd which could get some guests not able to afford the next 30 days payments and have to be evicted.Would appreciate any advice!

So for example if I rezone from RS-3 to RM4.5 and add a basement unit (4th unit), maybe I can then add a ADU above the garage, or do another studio in the basement, once the citywide program is opened up?
