No street parking means that any extra spaces this tenant takes up are spaces you can't give out to other tenants.I would tell him in no uncertain terms, and get it in writing and have him sign it, that his unit comes with one parking space.

I have found that, depending on the state (as you already seem to know), the requirements and "seriousness" of enforcement varies.There are ways (as another respondent posted) to structure such transactions such that they legally circumvent the applicable legislation.
