Hi Kathy the other alternative without the dst “tie up” is through a trust instrument that can set up the installment sale for you, defer your capital gain, even indefinitely, and be able to invest in whatever asset class you like, in whatever time period you prefer.

So very likely that when lender claims it "advanced" the taxes pursuant to some right reserved in the security instrument and adds to the balance... borrower will deny that is how things occurred, and they may be right.Idea is to protect against that possibility by getting a separate judgment lien for the taxes paid.

The instrument should be specific that he is personally liable until such time as you refinance, or he does something valuable for the company that would offset your monetary contribution, etc.
