I would respectfully mention your opinion and findings to them and ask for their thoughts.Keep in mind if you are just now filing the 2022 tax return then penalties and interest could be increasing this number.

Then it will carry forward in the 1031 as they file your form 8824.

Based on what you've said here, I'd offer that $72K as a base salary and bonuses based on profit and meeting deadlines. 

If you win, they will have to pay the extra expense of the filing fees, etc, on top of what you say your damages are (which would be the cost to hire someone else to complete the job).   

I've also heard that if neighbors file three valid police reports for the same tenant, you can ask them to leave.

You also have to do research on a few other things to avoid a suspended file in underwriting so this is why many lenders have stopped doing them.
