This alone leads me to believe it is distinguishable from our hypothetical but then add in that that part of the consideration for the contract was an agreement that the vendor would share in a portion of the goods produced in the future and the fact pattern diverges even more.Since the vendee could not comply with its obligations simply by signing a document i.e. a deed, the breach could not be resolved by specific performance.
