The only argument I've heard for going after the tenant even if you know you won't collect is kind of what I call "paying it forward".

I had that same song and dance in RI with a bad tenant.

Have your agents print out the sales for the area (that the comps), so you can see what things are selling for.  Go

I vote for going back and properly transferring ownership so both of you are in the clear.
