The lender still has to foreclose on the property after the bk to get title, so now you're looking at not only a bankruptcy, but a foreclosure after.

For this reason, it wouldnt make sense to rack up all the fees for title, escrow, lender fees, etc to do an investment cashout when you likely could get a personal loan at a similar interest rate, but only pay 300-500$ in document fees vice paying the 5-8K fees you'd likely rack up between the lender and title company with the refi.

In that scenario, I would also get depreciation benefits as the title holder.Using the syndication fund as been pretty smooth and easy, however, I'm not sure they have been raising enough capital to keep up with our growth pace so I'm looking for another alternative.

You appear to have found a property that doesn’t require property tax payments, title, hazard, or fire insurance, and a closing attorney or title and escrow that works for free on both the purchase and sale side.

My only complaint with them was when the loan was repaid, the title company overpaid the interest due in settlement and 8 months later they still haven’t refunded or provided an explanation- the only response I get back is “that loan sounds familiar and is on my desk but the closing hasn’t been approved”. 8 months later I don’t buy it...Experience 3: Lending one - refi on the house for a long term rental.
