If not lead safe, then mitigate.Liability insurance would never cover  “a municipality passing new laws...”Liability insurance might cover against harm you caused by unknowingly having an unsafe condition... but might reject the claim if it is deemed that you should have known.

I am saying that "Good intentions" often end up harming the borrower that is already in a stressed emotional and financial situation and someone without the appropriate licensure and experience could cause more harm than benefit.

I would read this affidavit closely before deciding to sign.If it really is just confirming he lived there then I don't see the harm, but you could have an attorney review it just to make sure.

Face value on the facts - your reimbursement for financial damages (rent) and physical injury/harm is not taxable - this is returning you to the position you should have been in.Any payments above that - emotional pain / suffering "for your trouble" punitive damages are taxable.
