Funny you should ask....I started the eviction process through magistrate court this past April.The previous owner (who's been living in the house, and who is still living in the house) fought the eviction I went to magistrate court 3 times about it and I thought it was about to be over with when I was told that the guy filed a federal lawsuit against me & the mortgage lender alleging fraudulent foreclosure.

Since the last alleged transfer of ownership was around 20 years ago, it is most likely that just the current "gifted" owner would show up and only his evidence would be considered..However, a key aspect of filing a Quiet Title action is the Court will require the filer to notify all persons with a recorded interest in the property (and their Heirs).
