The "units are occupied, please do not disturb tenants" is a curious sort of way to put things, it's true, but hey, it could mean nothing.You will need to investigate, and of course, part of that investigation will be to get into each of the apartments and look everywhere.

I'll be careful not to disturb the neighbors; If a contractor messes up and removes too much soil which damages or collapses a neighbors wall uphill am I responsible for re-mediating it or will the contractors insurance cover it?

The advantage comes from the fact that when excavating on the up slope, more often than not you are constantly cutting into the terrain and much of the soil remains undisturbed, or at least what is disturbed is compacted with the excavator while creating access ramps, etc...
