HML are generally ok with this because, hey, they got the points and interest they wanted, they got paid back, they can now go re-lend that money ASAP and collect those upfront points over again from someone else and keep the machine going.

If it is zoned something OTHER than what he wants to build then that throws a whole new issue in place because then you have to go re entitle the land which is more risky and could be open to public review etc.
