I don't believe a permit was ever pulled for this.I was going to fix it up to make it safe for use again (it has exposed nail points on the underside of the roof, and the floor is sagging in some areas).However, what I'm wondering is: even if I fix it up, and a tenant gets injured in there anyway (trips and falls) and sues me, will my insurance deny liability coverage anyway, if they find out it doesn't have a permit?

I believe bottom up refers to something that occurs during the operation of the LLC--tenant gets injured in house and sues, and the tenant/litigant attempts to get at your personal assets (which hopefully should be prevented by the LLC's corporate veil, unless you/LLC acted in a negligent manner).

If someone is injured working on one of your properties and you don't have worker's compensation insurance then you are subjecting yourself to paying up to $100,000 for an attorney if you settle through mediation, $300,000 for an attorney if the case goes to a jury trial, plus damages to the Plaintiffs, plus the Plaintiffs attorney fees that could be $100,000 to $300,000 and you could easily pay $500,000 to $1 million out of your pocket even if nobody can prove the Plaintiff is injured.

That lawsuit is a claim for fraud, and that’s what fraud typically is...a misunderstanding and someone being “injured” and wanting to hold the other responsible for it.
