#1 will violate the due on sale clause and trigger an acceleration of the outstanding balance. #2 creates a second layer of ownership (via the trust) that is unnecessary if you are still using the LLC.

@Austin Fruechting just curious were would you be if rents dropped 20 to 30% or if you had 20 to 30% cronic vacancy like what happened prior to you buying your portfolio..do you accelerate your paydowns with the hope to get this stuff paid for.. or just keep max leverage and live on the cash flow so you don't have to have a day job.???

Code Title 12, Chapter 13, Section 1701j-3 limits a lender from accelerating a note when there is a transfer to an inter vivos trust in which the borrower is and remains a beneficiary… I forgot to mention, a land trust is an inter vivos trust.Once the transfer is complete, your property will be titled in the name of your trust.

Hi @James Defazio,There are a number of strategies that you can consider, including:Tying up the Replacement Property through a lease option.Finding a way to accelerate the sale of the Relinquished Property.Or, look into structuring a Reverse 1031 Exchange transaction.The Reverse 1031 Exchange transaction would allow you to acquire and close on the purchase of your Replacement Property prior to selling and/or closing on the sale of your Relinquished Property.The challenge is that your equity is trapped in your Relinquished Property, so you must find a way to finance the purchase of your Replacement Property prior to closing on the sale of your Relinquished Property.
