If you're in a state like Massachusetts even if you're in the wrong and they DIDN"T put the money in a separate interest bearing account they're liable for triple damages.

They want $5K certified check up front to close on her house she is already living in.I can't get past the point that her own lending institution is charging her $5K up front for closing when closing is nothing more than telling their computer system to drop her rate a smidgen.

Here's the story: We recently purchased a rental property and since one of the units is a 3 bedroom we decided to get a lead paint inspection because in Massachusetts one is required if there is a child 6 years or younger living in the unit (which will most likely happen at some point with a 3br).
