All of that said, I would treat this tenant as month-to-month and enforce the 60 day notice requirement meaning that they are responsible for an additional 30 days of rent beyond their anticipated move-out date.

One additional item to consider is to buy an outdated property, rehab it and refinance it, this way you would have less cash into the deal and higher Cash on Cash Returns.

So, I don't think procuring cause applies here at all UNLESS they were using the OLD outdated no longer used Nonexclusive agency agreement but that wouldn't make sense because they talked about "cancelling" it which with a Nonexclusive agreement makes no sense.

At that point, if your tenant is not willing to renew,  you simply advise the tenant that you will not be renewing their lease, and provide them a move-out date by which they must vacate the property.
