I think you are right that it smells funny, and I shouldn't have to pay for the building's lack of timely maintenance and repair.I have a friend who is a real estate lawyer, although I have already run into hurdles.

Regarding the 1% 2%,  3% ...rule- It's great to understand these rules but you should eventually establish your own finance ROI benchmarks & hurdle rates.

I'm leaning towards a mark up of the 300k since the two lots to make up the 5-8 unit build each went for 268k which wouldn't make 300k all that unreasonable for adjacent property to their build.
